Law and Mental Health: Test Security Wars: Are test data and materials discoverable? -Bruce Borkosky, PsyD, PA Dr. Borkosky has had a varied career. He obtained a BA in psychology and music from Ohio Wesleyan U. Disenchanted with his career as a Domino’s Pizza manager, he obtained a Master’s in Computer Science and was hired by IBM as part of the PC-DOS programming team. Unable to shake his addiction to education, he obtained a Master’s and Doctorate in psychology from the Miami Institute of Psychology. Upon entering independent practice, he obtained most of a post doctorate in neuropsychology from Fielding Institute of Psychology. Having treated or evaluated more than 10,000 individuals, he continues to practice in person and via telehealth, specializing in individual psychotherapy, forensic evaluations, and veterans’ compensation and pension evaluations. Learning Objectives: 1. Explain the ethical and legal dilemma that occurs when disclosing test data. 2. Identify the two types of laws supporting test publishers right to withhold test materials and the court rule supporting the legal system’s right to access test data. 3. Compare the rate at which courts disclose test data to non-psychologists with the rate that courts order disclosure to another psychologist.
