Business Law - Introduction to Agency Law

Hey there, thanks for watching this video. We're going to be talking about agency law. Now agency law is a fundamental aspect of legal relationships and it governs how individuals and entities work together. So with that being said, we're going to dive into what is agency law.

We're going to talk about its relevance and explore some examples to help you better understand its practical applications. Now at its core, agency law is a set of legal principles that govern the relationship between individuals or entities where one party, the agent, acts on behalf another who we deemed a principle. Now this legal framework defines the rights, duties and responsibilities of both of those parties and helps to ensure a smooth and lawful interaction. Now there are several key elements of agency law that we're going to go into now.

The first of those is what's called consent. Now agency relationships begin with the consent of both parties, the principle, as well as the agent. This mutual agreement establishes the authority of the agent to act on behalf of the principle. The second key element of agency law is control.

Now the principle retains control over the actions of the agent, dictating the scope and limitations of the agency relationship. Now this control is important because it ensures that the agent acts in the best interests of the principle. The last key element of agency law is what we call a fiduciary duty. Now central to agency law is this concept of fiduciary duty where the agent is obligated to act with the utmost good faith, loyalty and honesty prioritizing the interests of the principle above their own.

This is particularly important, especially with investment relationships where let's say that you hire a broker who's responsible for managing your portfolio of different investments. Your advisor in this case has a fiduciary duty to act in the utmost faith, which means they need to be taking into consideration the best interests of you when prioritizing financial investments, not necessarily which investments result in the greatest commission on their part. So there is a little bit of a conflict of interest, but those particular parties are meant to engage or have a fiduciary duty where they need to put your needs and desires above their own. Now that you know a little about some of the different elements of agency law, let's talk about its relevance.

Now agency law plays a crucial role in various aspects of our daily lives, even if we don't know it, including things like business transactions to legal representation. So if you think about it, it's really the foundation of a lot of different relationships and business, including real estate where you're purchasing a home and you have a real estate agent who acts as, you know, your agent in that transaction and intended to represent your best interests, including employer employee relationships and many more than that. And understanding agency law is really vital for navigating these interactions and ensuring fair and lawful dealings. Now when an employer and employee relationship or in the workplace, the employer really acts as the principal and the employee is the agent and the employee is authorized to carry out tasks on behalf of the employer following the established terms of employment.

So if the employee acts in a certain way, then the employer can be liable for those decisions and so it brings into mind the importance of clarifying relationships and also the importance of good hiring practices. The next area is real estate transactions, which we mentioned a little bit before, real estate transactions often involve agency relationships where that real estate agent represents the interest of a buyer or a seller who would represent who would be the principal and obviously navigating the complexities of those particular property transactions and very similar to the example I provided before with regards to a financial advisor, real estate agents also have a fiduciary duty to make sure that they're representing their client's interests above their own. Another example of this agency type relationship comes into play with regards to what we call a power of attorney. Now this is a document that you may have heard of before in some capacity.

A power of attorney is a legal document that grants an individual, the agent, the authority to make decisions on behalf of another person who is the principal. This often comes into play with regards to parents and getting older and making financial decisions where one parent maybe provides power of attorney to one of their children as a way of giving them the authority to make maybe end of life decisions and financial decisions on behalf of them and as a prime example of agency law and action. Now as we conclude this video, I want you to remember that agency law is really the cornerstone of countless legal relationships and shapes, how individuals and entities kind of collaborate. So from consent to fiduciary duty to principles of agency law, these guide our interactions and it's important to fostering trust as well as accountability.
